This page tells you our Terms & Conditions on which we sell any of the products listed on our website www.theclothshop.co.uk to you.

Please read these terms & conditions carefully before ordering any products from our site. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.

How the Contract is formed between you and us:

After placing an order you will receive an email from us acknowledging that we have received your order.

Written Communication:

When using our site, you accept that communication with us will mainly be electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications should be in writing. This condition does not affect your statutory rights.

Personal Information:

Information that you provide to us remains confidential.In order for us to process your order and to provide the best level of service, it is necessary to temporarily collect and store a certain amount of personal of information, this includes your name & address, email and telephone contact details.

We will never collect sensitive information about you without your consent. We will never pass on your information. We will not sell or give your information to 3rd parties. We will not send you unwanted promotional emails without your prior consent and option to cancel.

Cookies:

This website sets strictly necessary cookies, they collect information about how visitors use a website, (eg which pages visitors go to most often, and if error messages appear). They do not collect information that identifies a visitor. All information these cookies collect is aggregated and therefore anonymous, used to improve how a website works. These cookies are essential in order to enable you to move around the website & use its features, such as accessing secure areas of the website. Without them services you have asked for, like shopping baskets & e-billing, cannot be provided.   

Prices & Payment:

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation. Orders will only be accepted if there are no material errors in the description of the goods or their prices as shown on this website.

We will normally verify prices as part of our dispatch procedures, so that where a product's price is less than our stated price, we will charge the lower amount when we dispatch the product to you. If a product's correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a dispatch notification if the pricing error is obvious and unmistakenable and could reasonably have been recognised by you as a mis-pricing.

Financial Information:

We do not store any information relating to your bank account, credit or debit card or Paypal account. When you make a payment the payment is processed on our behalf by Paypal.

Delivery Information:

Any time or date stated for delivery is an estimate only. We make every effort to dispatch goods on time, but we do not accept liability for failure to deliver within the stated time.

If we are unable to deliver the goods within 30 days of the date of the order, you will be entitled to cancel the order and request that any monies paid to The Cloth Shop in respect of that order to be refunded. In order to cancel, you must send written notice of cancellation to us at The Cloth Shop after the above date but before delivery of the goods or notification from The Cloth Shop that the goods are ready for delivery. 

We do not accept liability for shortages or damages to deliveries unless you notify us of the shortage and damage in writing within 7 days of receipt of the delivery.

You, as the customer, have to accept the goods when they are ready for delivery.

Delivery is deemed to have taken place when the goods are delivered to your nominated address, whereupon the risks of loss, breakage and all damage and all other risks shall pass to you. 

Title in the goods does not pass to you until payment is received in full by The Cloth Shop.

You may request a Proof of Posting, provided that this request is made in writing within 3 months of the date of delivery, and we shall use reasonable endeavors to provide such proof. Thereafter delivery shall be deemed to have been successfully completed. 

Import Duty:

If you order products from our site for delivery outside the UK, they may be subject to import duties & taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such duties or import taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs for further information before placing your order.

Please also note that you must comply with all applicable laws & regulations of the country for which the products are destined. We will not be liable of any breach by you of any such laws.

Refunds:

We are sure you will be completely happy with your purchase. If this is not the case we offer a fair returns policy. All we ask is that you NOTIFY us of your reason & intent to return your goods within 14 days of purchase and we will happily refund you (minus any postage costs).

Please note that any cut lengths of fabric, ribbon or trims cannot be returned or exchanged.

Goods are returned at your cost unless there has been a mistake on our part.

Please make sure you enclose in your return, a note of your name, address, purchase date & order number. Items must be returned in their original condition. Please obtain a Proof of Posting from the Post Office (they are free) as we are unable to accept responsibility for parcels lost in transit. 

If the goods returned appear to have been used or the packaging or labels are not intact, then a repackaging fee will be charged. We also reserve the right to refuse returns after inspecting the merchandise, or if we were not notified prior to the items being returned.

Please be aware we do not offer refunds on special orders, ie where we have supplied you with a 'non-standard' website item. 

Colours:

We have taken great care to photograph in natural daylight, however please bear in mind that colours may vary. Dye lots may also mean slight changes of colour should you make repeat purchases of any of our products. If you have any questions regarding this please contact us. You are advised to order a sample to check colours if necessary.

Our right to amend these Terms & Conditions:

We have the right to revise & amend these terms & conditions from time to time to reflect changes in market conditions which may affect our business, changes in technology, payment methods & relevant laws & requirements.

Disclaimer:

Whilst we endeavor to keep the information & products up to date and correct on the website, we make no warranties about the accuracy, reliability, sustainability or availability of information & products on this website. All items are for decorative purposes only and should not be treated as toys. Therefore products or packaging should not be given to babies or children.

Every effort is made to keep the website up & running smoothly. However, we take no responsibility for and will not be reliable for, the website being temporarily unavailable due to technical issues beyond our control.

Through this website you are able to link to other websites which are not under the control of The Cloth Shop. We have no control over the nature, content or availability of those sites. The inclusion of any links does not necessarily imply recommendation or endorse the views expressed within them.

Law & Jurisdiction:

These Terms & Conditions shall be governed by & construed in accordance with English Law and you hereby agree to be subject to the jurisdiction of the courts of England & Wales.

Ownership of Rights:  

All rights, including copyright, in this website are owned by The Cloth Shop. You may not modify, distribute or re-post anything for any purpose. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without permission from The Cloth Shop.
